The defense team also pointed out problems with the police's interpretation of "agreement."
The police stated in their warrant request that "representatives of the People Power Party (Jang Dong-hyeok) and the Korea Sports Council reached a consensus after persuading/negotiating with the protesters (as the police called them)," but the defense team strongly refuted this, stating it is "factually incorrect."
Specifically, they argued, "There were many citizens on-site who did not consent to the entry, and the so-called 'agreement' was merely reached between specific National Assembly members and some Korea Sports Council officials. It cannot be seen as an agreement by all participating citizens; the suspect and many other citizens did not agree. Therefore, the police and prosecution's claim that the suspect 'arbitrarily neutralized the agreement' is wrong in its premise."
Furthermore, they noted, "Unlike the parliamentary inspection (conducted on July 2nd), which had separate legal grounds, the agreement between certain party members and Korea Sports Council officials at the time did not have legal basis, nor can it be seen as a consensus of everyone. Many citizens surrounded the Olympic Park for over 47 days, shouting about election fraud and demanding a re-election; it has not even been established whether the counting was truly finished, or whether arbitrary visits without legal grounds are permissible in a location where the preservation of evidence is necessary."
Regarding the police's claim that "Oldarc" said, "If you sue me for obstruction of business, I will take all the punishment," the defense team stated, "The suspect never made such a statement. The police are using this as key evidence of intent, but it is a serious problem that they have recorded a statement that does not conform to the facts as part of the criminal record."
The claim that the 2-1 gate was the "only entrance" to the handball gymnasium was also criticized as an irrational assertion in the police warrant request.

The defense team responded, "This is factually incorrect. Regarding the police's claim that "a consensus was reached after hours of persuasion," the defense team pointed out, "On-site video from that day shows many citizens besides the suspect shouting, 'Evidence preservation is not finished,' 'Don't open the door,' and 'Stay strong.' If an agreement had been reached as the police claim and only the suspect was dissenting, such video could not exist; this is clear evidence that many citizens on-site were opposed to the entry."
They also emphasized, "Evidence preservation procedures related to the election had not been completed, and it was difficult to see the counting as fully finished. The suspect's actions were intended for evidence preservation in such a situation."

The defense also strongly countered the police's assertion that the slogans shouted were "election fraud conspiracy theories."
Lawyer Park Ju-hyeon presented clear clues for the fraud in the opinion, stating, "The election records of the Songpa-gu Election Commission actually show that the number of ballots issued was 57 less than the total number of votes cast. This means more votes were cast than ballots issued, which suggests the existence of at least 57 unidentified counterfeit ballots." He told the court, "This is a phenomenon that should not happen in the election process."
"Dismissing a protest against the infringement of suffrage based on such objective facts as a mere 'conspiracy theory' is unjust, and it shows that the suspect's actions are based on legitimate questioning," he stated.
Furthermore, the defense team added, "Oldarc's actions have legitimacy in their purpose as a protest against the infringement of suffrage based on the objective fact of the mismatch between the number of ballots issued and the total votes cast."
The defense also emphasized that "Oldarc's" act of "blocking the door" does not constitute "force."
Although the police claimed in their warrant request that she used force, the defense team countered, "It is difficult to view the suspect, who is a woman, as possessing enough power to suppress the free will of the victims," and submitted as evidence a news report where Seoul Metropolitan Police Agency Commissioner Park Jeong-woong stated to People Power Party lawmakers, "It was easy to pull Oldarc away, but we didn't take action due to the possibility of a conflict."
