After former President Yoon Suk-yeol refused to appear for a second summons by the special prosecutor regarding charges of insurrection, the special prosecutor's team has initiated compulsory apprehension procedures. This marks the first time in 30 years, since former President Chun Doo-hwan, that compulsory investigation of a former president may become a reality, placing it at a significant legal and political crossroads.

During a press briefing on the afternoon of the 14th, Park Ji-young, special prosecutor's assistant for the Jo Eun-seok special prosecutor's team, announced, "We have sent an official directive to the warden of Seoul Detention Center to bring the suspect, Yoon Suk-yeol, to the investigation room within the Seoul High Prosecutors' Office building by 3:30 PM today."

This measure was taken after former President Yoon failed to appear for his second summons, following his refusal to attend the first investigation on the 11th. Correctional authorities reportedly informed the special prosecutor's team of former President Yoon's intention not to attend around 12:40 PM today.

Prosecutor's Assistant Park emphasized, "In the criminal justice process, the appearance of a detained suspect is a natural obligation. While the right to remain silent is a suspect's right, there is no right to refuse to appear." He added, "We are fully considering the courtesy due to a former president, as demanded by society, but the principle of equality before the law cannot be an exception."

However, some critics argue that the special prosecutor's compulsory investigation is inconsistent with political fairness. In a situation where a current president repeatedly requests a stay of criminal proceedings in numerous trials and the courts grant these requests, they contend that pushing for a compulsory investigation of a former president is excessive, suggesting a biased application of the law where those with power are acquitted and those without are convicted.

Specifically, some within the conservative camp are protesting, stating, "While compulsory appearances are being threatened for former President Yoon after his detention, the current president, despite being a defendant, is evading appearing for trials. The application of law differing based on the presence of power is a threat to democracy."

Former President Yoon had previously refused the first summons citing health reasons. After reviewing his medical records, the special prosecutor's team determined he was "capable of being investigated" and issued a second summons, but he again did not appear today.

If compulsory apprehension is actually carried out by this afternoon, it would be the first such instance since former President Chun Doo-hwan, who was forcibly apprehended in 1995 after refusing three summonses on charges of insurrection.

Legal circles and observers alike predict that this case could set a new precedent for the legal process concerning former presidents, while also highlighting the challenge of restoring public trust in the political neutrality of the judiciary.
