Regarding "Pushing for legislation of 'Independent Confiscation System' within the year to confiscate criminal proceeds from Cambodia"


"Currently, proceeds can only be confiscated after a guilty verdict, delaying victims' return to daily life."

The Democratic Party announced on the 23rd that regarding various crimes targeting Koreans in Cambodia, "we will promptly push for legislation of an independent confiscation system that allows for the confiscation of criminal proceeds regardless of whether a guilty verdict has been reached."


Moon Jin-seok, Deputy Floor Leader for Operations of the Democratic Party, stated at a National Assembly Audit briefing this morning, "The real victims of the Cambodia situation are the numerous citizens who have lost their assets and are suffering," and said this.


He pointed out, "Under the current system, criminal proceeds can only be confiscated after a guilty verdict, and victims must wait until then. Even if the main culprit is apprehended and repatriated, criminal proceeds cannot be confiscated before a guilty verdict. This inevitably delays victims' return to daily life."


He further emphasized, "The consensus for introducing an independent confiscation system was already formed during the issue of recovering the slush funds of former presidents Chun Doo-hwan and Roh Tae-woo," adding, "Eight related bills are pending in the National Assembly, and the Financial Action Task Force (FATF) also recommends its introduction."


He concluded, "We will work with the government to promptly push for the legislation of an independent confiscation system within this regular parliamentary session. As this is an issue directly related to people's livelihoods, we request the active cooperation of the opposition party."


Earlier, Minister of Justice Han Dong-hoon also stated on Facebook the previous day, "The introduction of an independent confiscation system is necessary to prevent the second and third Cambodia situations and to respond to transnational crimes that occur beyond borders, such as child sexual exploitation offenses," and requested related legislation from the National Assembly.
