Moon Hyung-bae, former acting chief justice of the Constitutional Court, also expressed his opposition to the judicial reforms being pursued by the ruling party and the government.

According to Yonhap News, Moon stated during a lecture held at the auditorium of Inje University in Gimhae, Gyeongnam on the 20th, "I oppose the judicial reform measures, such as the Court of Cassation, currently being pursued by the ruling party, and it is not something that should be rushed."

The report states that Moon explained the differences between the Supreme Court and the Constitutional Court, saying, "This is to allow appeals against Supreme Court rulings, which are the third instance, to be transferred to the Constitutional Court, essentially creating a fourth instance," and added, "It is questionable whether there are sufficient constitutional grounds for the Constitutional Court to overturn a Supreme Court ruling."

He argued, "Considering that the majority of Constitutional Court justices do not require the National Assembly's consent, while all Supreme Court justices do, doesn't it seem that the Supreme Court has the upper hand?" He concluded, "It is my opinion that when our Constitution was drafted, there was no intention for the Constitutional Court to be above the Supreme Court."
