A disciplinary complaint has been officially filed against the Supreme Court justices responsible for election nullification lawsuits for the presidential and parliamentary elections, as the cases have significantly exceeded the 180-day statutory processing deadline stipulated in the Public Official Election Act.

According to the New Party for Free Korea (led by former Prime Minister Hwang Kyo-ahn) on the 3rd, the party's Special Committee on Election Irregularities Reform (chaired by Dr. Wi Geum-suk) submitted a formal disciplinary complaint to the Supreme Court on the 26th of last month against six justices, including Supreme Court Justice Roh Kyung-pil.

The Special Committee on Election Irregularities Reform pointed out that the election nullification lawsuit filed on June 23rd of last year has not yet been ruled upon as of January 3rd of this year, constituting a serious violation of Article 225 of the Public Official Election Act.

They argued, "This prolonged inaction goes beyond simple procedural delays and constitutes a violation of official duties under Article 2, Subparagraph 1 of the Act on the Disciplinary Punishment of Judges, and an act that impairs the dignity of a judge under Article 2, Subparagraph 2 of the same Act," requesting the Judge Disciplinary Committee to conduct a thorough investigation and render a stern disciplinary decision.

Specifically, the special committee officially requested the Judge Disciplinary Committee to: commence disciplinary investigations, thoroughly investigate whether the respondents have neglected their duties and violated their obligations, render a severe disciplinary resolution based on the investigation results, and revise internal guidelines to strengthen the Supreme Court Chief Justice's principle of prioritizing the review of election lawsuits.

Chairperson Wi Geum-suk emphasized, "Election nullification lawsuits are highly public interest cases directly linked to a nation's democratic legitimacy. The longer the rulings are delayed, the more rapidly public trust in the judiciary collapses, and it raises suspicions that the judiciary is infringing upon the rights of the people due to political considerations or organizational complacency."

The legal grounds for this disciplinary complaint include: Article 225 of the Public Official Election Act (obligation to process election lawsuits within 180 days), Articles 27(1) and (3) of the Constitution (right to seek judicial recourse and right to a speedy trial), Articles 1 and 3 of the Code of Judicial Ethics, and Article 2, Subparagraphs 1 (violation of official duties) and 2 (act impairing dignity) of the Act on the Disciplinary Punishment of Judges.
