President Donald Trump said Friday that Barack Obama “committed crimes” but “probably” benefited from a Supreme Court ruling on presidential immunity.
Tulsi Gabbard, Director of National Intelligence, announced last week that she is presenting “overwhelming evidence” to the Department of Justice. This shows that then-President Obama and his national security team laid the groundwork for a “coup” related to Russia over “many years” against Trump, who defeated Hillary Clinton in 2016.
The Supreme Court ruled on July 1 last year that former presidents have a certain level of immunity from prosecution. At the time, the ruling had the effect of extending the stay of proceedings in a Washington criminal case in which President Trump was indicted for attempting to overturn his 2020 election defeat.
Thanks to that ruling, President Trump was able to run in the 2024 presidential election without incident. At the time, the ruling was made by six conservative justices. Three progressive justices dissented. Ironically, the ruling may save a former Democratic president.
After the ruling, Trump was shot by an assassin in Butler, Pennsylvania, on July 13.
On Friday, as President Trump spoke with reporters outside the White House, he was asked if the Supreme Court's immunity ruling could help President Obama avoid potential prosecution for the Russia Gate.
“The immunity ruling will help him a lot,” Trump told reporters before departing for Scotland. “It will probably help him a lot. But it doesn't help anyone around him at all. But it will help him a lot.”
“There is no doubt in my mind that he committed crimes. But he has immunity, and that will have helped him a lot,” Trump said.
Unlike President Trump's response, many say that former President Obama will not benefit from immunity.
Presidential immunity has exceptions, and it cannot be enjoyed in the following cases: (1) Unofficial or personal conduct, (2) Treason (as defined in Article III, Section 3 of the Constitution, the act of levying war against the United States or aiding its enemies), (3) Crimes outside of official authority: Federal or state crimes unrelated to constitutional duties, such as fraud, (4) Civil liability for personal actions: Lawsuits for actions unrelated to public office, and (5) Actions after leaving the presidency.
