Lawyer Lee Ha-sang analyzes President Yoon Suk-yeol's verdict. [YouTube Channel 'Attacking Lawyers' Live Capture] 

“About 60% of the public approves of President Yoon Suk-yeol's declaration of martial law, but the judiciary is full of judges like Baek Dae-hyeon who consider emergency martial law to be rebellion.” 

Lawyer Lee Ha-sang lamented this on the live broadcast of the YouTube channel ‘Attacking Lawyers’ on the night of the 16th, saying, “Because we (conservatives) have lost our hegemony, we cannot even participate in the reproduction structure of judges.” 

He asked himself, “Is the judiciary composed of judges in proportion to public opinion?” and repeatedly dismissed it, saying, “No, no,” asserting, “Reproduction is not happening in that way.” 

It has long been argued that the judiciary has rapidly leaned left since Moon Jae-in appointed Kim Myeong-su as Chief Justice. 

Lawyer Lee pointed out, “The judiciary is saturated with people like Baek Dae-hyeon,” and stated, “Judges who dislike President Yoon’s emergency martial law and consider it rebellion make up 80-90% of the numerical strength and are set up this way. This is also manipulation, manipulation of personnel composition.” 

He then directly criticized, “If 60% of the public thinks the President’s emergency martial law is not a crime, there should be 60% of judges, but it’s not like that. The People Power Party played a big role in this, because they didn’t say anything.” 

He went on to emphasize, “The law and evidence of judges who believe (martial law is a crime) conclude that President Yoon is guilty, while fake president Lee Jae-myung is acquitted because any act by him lacks evidentiary value. Should we appeal to such people? We should not appeal. We must fight back. We must shout. If we don’t shout, our rights will not be guaranteed.” 

On this day, he also rebuked Chief Judge Baek Dae-hyeon, who had sentenced President Yoon to five years in prison, by comparing him to a Bible verse. 

Lawyer Lee mentioned, “Joshua 14:7 contains a passage where Caleb, after spying, reports to Moses, saying, ‘I reported according to my conviction.’ He noted, “The key point is why he didn’t say it was an objective report.” 

He viewed it as, “Because they sent scouts, they should have reported what they saw on the ground as objective facts, but he reported what was in his heart.” 

He argued that while “we mistakenly believe there are objective judgments, legal principles, and substantive facts, judges, if we don’t fight, will make judgments based on the default settings, the judgments in their hearts, the judgments in Baek Dae-hyeon’s heart.” He criticized, “The human named Baek Dae-hyeon views the substantive relationship under the belief that it is right to punish President Yoon, and he also fits the legal principles accordingly.” 

Furthermore, he lamented, “It’s truly a case of ‘if it fits the nose, it’s a nose ring; if it fits the ear, it’s an ear ring.’ (Judges) say evidence is inadmissible for those they want to favor, and admissible for those they don’t. That logic can be applied however they want, which is truly maddening.” 

In particular, he urged the audience to empathize with the fighting direction of the ‘Attacking Lawyers’ team, stating, “In the trial of the free youth of the Western District Court, despite so much questionable digital evidence, not a single judge in the first and second instances removed its admissibility, and this is the substance of Korean law. Our country is so divided and split to the point of being irreconcilable. If we do not subdue and execute them in this fight, we cannot win.” 

Finally, Lawyer Lee stated definitively, “If we think naively, we will always lose. This is because the conscience of judges is set on the perception that President Yoon committed rebellion by declaring martial law, and they are people who actively agree with such thoughts.” 

Earlier, on the 2nd, the new party 'Freedom and Innovation' (led by former Prime Minister Hwang Kyo-ahn) filed a joint complaint with the U.S. federal government and the UN Human Rights Council's Special Rapporteur against Chief Judge Baek Dae-hyeon of the 35th Criminal Division of the Seoul Central District Court, who is presiding over President Yoon's criminal trial. 

'Freedom and Innovation' claimed that Judge Baek "seriously infringes upon President Yoon's right to defense and right to a fair trial" and requested that the U.S. government and the UN conduct immediate investigations and express official concern to the Korean government. 

This complaint was filed during President Yoon's trial, after he was charged and arrested as a rebel following his declaration of emergency martial law on December 3, 2024, under the pretext of 'eradicating pro-China leftist forces and election rigging cartels.'
