The legal team for former President Yoon Seok-yeol has filed an application for a stay of execution with the court regarding the first-instance ruling ordering compensation for mental damages suffered by citizens due to the 12.3 emergency martial law. This move follows Yoon's appeal of the first-instance ruling and is interpreted as a measure to prevent provisional enforcement of the judgment before it becomes final.
According to the Seoul Central District Court on the 30th, Yoon's side filed an application for a stay of execution for the first-instance ruling that ordered compensation of 100,000 won per person.
The stay of execution case will be heard by the Civil Appeals Division 8-3 (Presiding Judges Shin Young-hee, Jeong In-jae, Kim Ki-hyun) of the same court.
Previously, on the 25th, Presiding Judge Lee Sung-bok of the Civil Division 2 at the Seoul Central District Court ruled in favor of the plaintiffs in a damages lawsuit filed by 104 citizens against former President Yoon, ordering compensation of 100,000 won per person.
The court also declared provisional enforcement possible at that time. Provisional enforcement allows for the compulsory enforcement of compensation payments even before a judgment is finalized. While the principle is that enforcement can only occur after a judgment is finalized, provisional enforcement is sometimes permitted for the prompt realization of rights.
In response, the defendant's side typically files an application for a stay of execution to block the effect of provisional enforcement.
Yoon's side appealed the first-instance ruling on the 29th, submitting the appeal brief to the Central District Court, which presided over the original trial.
If the court accepts the application for a stay of execution, provisional enforcement will be prohibited until a deadline set by the court. If the application is not accepted, the state of provisional enforceability will remain. Yonhap News
