The U.S. Supreme Court has paved the way for the Donald Trump administration to deport hundreds of thousands of immigrants under Temporary Protected Status (TPS).
On the 25th (local time), the Supreme Court ruled that the Trump administration's termination of 'Temporary Protected Status' (TPS) for Haitian and Syrian immigrants is not subject to judicial review by the Court.
This ruling means that the courts cannot interfere with the administration's decision to end TPS, effectively upholding the Trump administration's position. The decision was reached with six conservative justices in favor and three liberal justices dissenting.
TPS is a program established by the U.S. in 1990 to prevent immigrants from being deported to their home countries when they are facing emergencies such as armed conflict or natural disasters. It allows immigrants to stay in the U.S. for 18 months, with the possibility of renewal.
The New York Times (NYT) reported that the Supreme Court ruling could lead to the deportation of 350,000 Haitians and approximately 6,000 Syrians. The Washington Post (WP) noted that there were about 1.3 million immigrants across 17 countries with TPS status during President Trump's previous term, and predicted that this ruling would affect them as well.
On the same day, the Supreme Court also ruled that the Trump administration may turn away asylum seekers at the Mexican border before they can enter the U.S. if they claim to face persecution.
Initially, the U.S. allowed those seeking asylum to apply and request protection once they arrived at the border, but restrictions were put in place during the Barack Obama administration following a surge in immigrant arrivals.
President Trump significantly expanded the scope of these restrictions during his first term. Although the Biden administration later removed these "turn-back" regulations, the Trump administration's plan is to revive them.
This ruling was also decided by a 6-3 vote, with the conservative justices in the majority and the liberal justices in dissent. The conservative justices held that in order to qualify for asylum in the U.S., one must cross the border completely and step onto U.S. soil.
Liberal Justice Sonia Sotomayor read her dissenting opinion in court. Expressing a dissenting opinion in court signifies strong opposition to the majority opinion.
Conservative Justice Samuel Alito, who wrote the majority opinion, appeared displeased, noting that he was unaware of Justice Sotomayor's plan to read her dissent. The Washington Post pointed out that this may indicate friction or a lack of communication among the justices.
Today's ruling is seen as a victory for President Trump, whose administration has emphasized the necessity of strict immigration enforcement, from a Supreme Court with a conservative majority.
The White House welcomed the Supreme Court's ruling. White House Press Secretary Abigail Jackson called it a "tremendous victory," stating, "The Trump administration is legally putting an end to the gross abuse of an immigration system that has long plagued the American people."
Senate Majority Leader Chuck Schumer (Democrat) condemned the decision as "cruel and inhumane," adding, "TPS was meant to protect people for whom it is not safe to return home, but Trump and the Supreme Court have chosen cruelty, chaos, and fear."
However, rulings on major cases, such as the executive order banning birthright citizenship, are still pending. The Supreme Court is expected to conclude its rulings by next week before entering its summer recess, and media outlets speculate that the birthright citizenship ban is likely to be ruled unlawful.
