Conservative pundits, online commentators, and some federal lawmakers are criticizing Supreme Court Justice Amy Coney Barrett over two major rulings related to the Trump administration’s political agenda: birthright citizenship and mail-in ballots, Just the News reported late Tuesday (local time).

In one of those cases, Justice Barrett and Chief Justice John Roberts joined the court's liberal justices on Monday in upholding a Mississippi law that allows mail-in ballots postmarked by Election Day to be counted if they arrive within five days afterward, dealing a blow to Republican efforts to restrict mail-in voting ahead of the midterm elections.

Then, on Thursday, Barrett and Roberts once again joined the liberal wing in the case of "Trump v. Barbara," ruling that birthright citizenship applies to both illegal immigrants and non-citizen visitors, effectively rejecting President Donald Trump’s executive order to revoke automatic citizenship in such cases.

While Chief Justice Roberts also joined these rulings, Justice Barrett has faced the brunt of the criticism and attacks from Republican and conservative circles who believe the cases were wrongly decided.

"Traitor" or "Fair Arbiter"?

Appointed by President Trump in 2020 to succeed the late Justice Ruth Bader Ginsburg, Barrett played a key role in cementing the court's current conservative majority. However, some conservatives view these recent rulings as a betrayal, and their criticism goes beyond the merits of the decisions themselves.

Former TV host Megyn Kelly said on her Sirius XM show earlier this week after the election-related ruling, "Amy Coney Barrett is a traitor," adding, "She is constantly siding with the left."

Rep. Nancy Mace (R-S.C.) stated after the birthright citizenship ruling, "Amy Coney Barrett should be removed from the Supreme Court."

Daily Wire podcast host Matt Walsh remarked, "Amy Coney Barrett was ultimately a DEI hire, barely better than Ketanji Jackson. A terrible pick. When was the last time a Republican president didn't appoint a liberal justice?"

Others have accused Barrett of causing dire consequences, including the future destruction of the country.

Conservative activist Laura Loomer commented, "There is something twisted and ironically funny about the fact that Amy Coney Barrett, a Supreme Court Justice whom Sen. Mitch McConnell urged President Trump to nominate on his very deathbed, voted against President Trump's executive order on birthright citizenship, effectively sending our country to the grave."

The College Republicans chapter at the University of Notre Dame, where Barrett studied law, criticized the Justice as "a stain on the honor of Notre Dame." The group posted on X (formerly Twitter), "We apologize on her behalf to everyone who will suffer the devastating consequences of endless Third World immigration."

"Both sides have good-faith arguments on birthright citizenship"

Barrett found defenders among legal scholars, both those who disagreed with the ruling and those who supported it.

Amy Swearer, a senior legal fellow at Advancing American Freedom, defended Justice Barrett even while noting that she personally disagrees with her logic, despite the fact that Justice Clarence Thomas had cited her research in his dissent on the birthright citizenship case.

"Justice Barrett has a wrong view of the citizenship clause," Swearer wrote. "But some of you here are acting as if (...) Justice Barrett has not been consistent on numerous issues, *including other opinions released today*..."

"Act like adults. Get a grip on your emotions," she added.

Jonathan Turley, a law professor at George Washington University and legal commentator, also defended Justice Barrett despite disagreeing with the court's ruling.

"As one of the three justices appointed by President Trump, Justice Barrett has gotten under the skin of many," he wrote. "Many expected her to follow the same path as Justice Samuel Alito or Justice Thomas, but instead, she has often aligned herself with Chief Justice Roberts."

However, he added, "The attacks on Justice Barrett overlook the fact that there are good-faith arguments on both sides of the birthright citizenship case. They also ignore the fact that she has regularly voted with the conservative wing and supported the administration's positions."
