The Cho Eun-seok special prosecutor's team for rebellion has requested an arrest warrant for Hwang Kyo-ahn, leader of the new party "Freedom and Innovation" and former Prime Minister, who was arrested on charges of instigating rebellion.
According to comprehensive domestic media reports on the 12th, the special prosecution team announced in a press release on the same day, "We have requested an arrest warrant for former Prime Minister Hwang Kyo-ahn on charges of instigating rebellion at around 6:50 PM today."
The immediate request for an arrest warrant on the day of arrest is unusual.
The special prosecution team alleges that former Prime Minister Hwang participated in rebellion propaganda by posting a supportive message for the declaration of martial law on his Facebook page on December 3rd of last year, when former President Yoon Suk-yeol declared martial law.
In response, former Prime Minister Hwang is known to have denied all charges, stating, "The declaration of martial law is not rebellion."

According to officials from the Freedom and Innovation party on the 12th, Mr. Hwang was taken into custody from his home around 10:30 AM and has been exercising his right to remain silent as of 3 PM.
The special prosecution team had previously dispatched police to Mr. Hwang's home in Yongsan-gu, Seoul, early in the morning, forcibly opened the door around 8 AM, and entered the premises.
According to party officials, the special prosecution team presented Mr. Hwang with an arrest warrant before executing it, and conducted a search and seizure for nearly two hours starting at 9:30 AM. Lawyer Park Ju-hyun was present at the scene.

The arrest warrant is valid for 48 hours. The special prosecution team is reportedly considering requesting an arrest warrant.
The National Movement Headquarters for the Rectification of the Republic of Korea (Daegukbon) immediately issued a statement strongly condemning the special prosecution's execution of the arrest warrant.
In its statement, Daegukbon argued, "Martial law is a legal system established by the Constitution, and defining it as rebellion, an emergency measure to prevent national chaos, is a direct denial of the Constitution." Furthermore, it criticized, "To frame an act of expressing one's opinion on a personal SNS immediately after the declaration of martial law, out of concern for national chaos, as 'incitement to rebellion' is an act that simultaneously undermines the boundaries of common sense and law."
It continued, "The crime of incitement to rebellion is established only when there is direct incitement to overthrow the system by force. The claim that 'Facebook posts' constitute incitement to rebellion has no legal basis whatsoever." It added, "Anyone who knows criminal law will understand this. This is not the application of law, but a targeted investigation based on political intent."
Daegukbon further lamented, "The forced arrest of an individual who served as Prime Minister and Minister of Justice from their home at dawn is not an execution of justice but political retaliation." It condemned, "The special prosecution's coercive investigation, disregarding due process and common sense, is a rampage by a political judicial institution serving the commands of the regime, not the law."
Three party officials arrested on charges of obstruction of official duties during the attempted execution of the warrant were taken to the Gwangjin Police Station detention center in Seoul around 11:30 AM.
Other party officials and supporters are strongly opposing the execution of the warrant, labeling it a "violent act."

Meanwhile, citizens, party officials, and members of the "Anti-Election Fraud and Corruption Brigade" have been maintaining a presence at the scene in preparation for a potential surprise re-execution.
