Former Justice Minister Park Sung-jae, who is accused of 'collusion in rebellion' related to the December 3rd martial law, has once again narrowly escaped an arrest.
After conducting a suspect interrogation before arrest (warrant review) for former Minister Park on the 13th, Seoul Central District Court Judge Nam Se-jin dismissed the arrest warrant, stating, "There is still room for dispute regarding the charges, and it is deemed necessary to grant him sufficient opportunity to defend himself while he is not in custody."
Minister Park is accused of sequentially participating in former President Yoon's rebellion crimes by convening a meeting of Justice Ministry bureau chiefs and directors after the declaration of martial law, and by ordering the review of dispatching prosecutors to the joint investigation headquarters, checking the capacity of correctional facilities, and ensuring the attendance of officials responsible for exit bans.
The special prosecutor's team requested an arrest warrant for former Minister Park on November 9th, applying charges of engaging in important rebellion duties and obstructing the exercise of authority. However, the court dismissed the warrant, stating that there was room for dispute regarding the extent of Park's awareness of the illegality and the illegality of the measures taken by Park.
Subsequently, the special prosecutor's team reinforced the evidence regarding former Minister Park's awareness of illegality through additional investigations and searches and seizures related to the case, and re-requested an arrest warrant after adding some of the criminal facts. However, the court again dismissed the warrant, failing to secure his custody.
