  • The moment the composition of the bench is designed, the separation of powers collapses… we must eliminate, not minimize, the possibility of unconstitutionality.

The People Power Party urged the Democratic Party of Korea to withdraw its bill to establish a dedicated court for insurrection, stating on the 9th that "the separation of powers collapses the moment the ruling party designs who will preside over the court."

In a commentary, Senior Spokesperson Choi Bo-yoon said, "The Democratic Party announced that they would postpone the plenary session for the bill to establish a dedicated court for insurrection to 'minimize constitutional disputes.' Constitutional issues should not be minimized; they should be eliminated," she stated.

Choi mentioned that concerns about the bill have been expressed by various groups, including the Conference of Chief Judges of Korea, the Korean Bar Association, and the reformist lawyers' group Minbyun (Lawyers for a Democratic Society). She emphasized that it is "an evil law that should be immediately abolished, not a problem that can be solved through supplementation or revision."

Deputy Senior Spokesperson for the Floor Leader, Choi Eun-seok, also issued a commentary, pointing out that voices expressing concern about the constitutionality of the bill were raised not only within the legal community but even during the Democratic Party's general meeting the previous day.

Deputy Floor Leader Choi said, "While national chief judges are warning that it is 'unconstitutional,' and even Democratic Party lawmakers are saying 'this is excessive,' only the leadership of the Democratic Party is pressing the accelerator. The bill to establish a dedicated court for insurrection must be immediately abolished."

He added, "The Republic of Korea should not become a country where the ruling party can, with a mere whim, bring anyone accused of insurrection before a special court. The Democratic Party will soon bitterly realize the fate of politics that uses laws as a tool of power."

The Democratic Party had planned to submit the bill to establish a dedicated court for insurrection and other legislative proposals to the National Assembly plenary session on this day. However, due to constitutional disputes arising from within the party and the legal community, they decided to postpone the bill's processing by about ten days and adjust its detailed provisions.
