As the Supreme Court deliberates on President Donald Trump's executive order regarding birthright citizenship, award-winning investigative journalist Peter Schweizer claims that new revelations about how China exploits U.S. laws could significantly impact the case.
In his new book, "The Invisible Coup: How American Elites and Foreign Powers Use Immigration as a Weapon," released on Tuesday, Schweizer analyzes the role of China and Mexico in facilitating illegal immigration to the United States, as well as how the Chinese government has exploited the U.S. citizenship system.
Citing Chinese government data and independent assessments, Schweizer and his research team estimate that between 750,000 and 1.5 million Chinese nationals have obtained U.S. citizenship by exploiting loopholes in birthright citizenship laws over the past 13 years, a practice known as "birth tourism."
While birth tourism from China has long been a concern, Schweizer believes the newly estimated scale has significant implications for the Supreme Court, which is currently examining whether President Trump has the authority to narrow the definition of birthright citizenship under U.S. law.
In an interview with Just the News, Schweizer stated that birth tourism by Chinese nationals is "highly organized, particularly by the Chinese government, and they have built a system that can be operated on an industrial scale."
He added that the Chinese government has its own estimates, reporting that "approximately 100,000 Chinese individuals have obtained citizenship in this manner every year over the past 13 years, which means over a million people."
According to estimates from Chinese authorities and scholars cited in Schweizer's new book, the number of Chinese individuals born on U.S. soil who automatically gained U.S. citizenship ranges from 750,000 to 1.5 million.
This data could have a significant impact on President Donald Trump's executive order, planned for January 20, 2025, which aims to restrict citizenship for those born in the U.S. if their parents are undocumented or on temporary visas.
While the executive order immediately faced backlash, the Trump administration requested judicial review of two cases. The Supreme Court has agreed to hear the first of these cases, "Babbitt v. Trump," this term.
In that lawsuit, U.S. District Court Judge Joseph N. Laplante of New Hampshire issued a preliminary injunction to halt the enforcement of the executive order for babies born after February 20, 2025.
The other case, "Trump v. Washington," saw the Ninth Circuit Court of Appeals rule the Trump executive order "invalid" as it violates the "plain text" of the 14th Amendment. The Supreme Court has taken no action on this case.
The 14th Amendment was added to the Constitution in 1868, after the Civil War. It states, "All persons born or naturalized in the United States and subject to its jurisdiction, are citizens of the United States and of the State wherein they reside."
This amendment was intended to overturn the Supreme Court's 1857 ruling in Dred Scott v. Sandford, which held that descendants of slaves were not U.S. citizens and therefore not entitled to protection from U.S. courts.
Later, in the 1898 case United States v. Wong Kim Ark, the Supreme Court affirmed that the 14th Amendment "confirms the ancient and fundamental principle of citizenship by birth in any territory over which the nation exercises its sovereignty, embracing all children born of resident aliens under the jurisdiction of the United States." In this case, the court rejected the government's claim that Wong Kim Ark, born to Chinese parents, was not a U.S. citizen.
However, Schweizer explains, "These children are primarily the offspring of Chinese elites, born in the United States. They then return to China to grow up, attend Chinese schools, and become members of the Chinese Communist Party elite. When they turn 18, they can vote in U.S. elections and are eligible for employment in government agencies."
He stated, "This is a critical issue directly related to national security, and I believe the Supreme Court must understand this point."
Birth tourism by Chinese nationals gained traction during the Obama administration. In 2009, the Obama administration opened the door to birth tourism by creating a special parole program that allowed Chinese citizens to visit the Commonwealth of the Northern Mariana Islands (CNMI) without a visa.
This month, federal senators sent a letter warning Secretary of Homeland Security Kirstjen Nielsen and Secretary of the Interior Doug Bernhardt about this "long-standing policy."
The senators stated that the policy has "exposed the U.S. to serious security risks by creating a kind of small industry where Chinese nationals give birth in the CNMI and obtain U.S. citizenship." Since 2009, birth tourism by Chinese nationals has surged in Saipan, the capital of the U.S. territory.
Schweizer specifically points to the issue of surrogacy.
Last year, police uncovered another form of "birth tourism" when they discovered Guo Jun Xuan and Sylvia Zhang caring for over 20 children born via surrogacy in a secluded mansion outside Los Angeles.
According to ABC News, Xuan was convicted and imprisoned in 2014 for masterminding a fraudulent immigration scheme that submitted approximately 800 false asylum applications on behalf of Chinese nationals.
Authorities became aware of the couple after their two-month-old son was rushed to the hospital with suspected signs of abuse. Investigations revealed that Xuan and Zhang had hired surrogate mothers across the United States to carry their children. Many of the surrogates were unaware that other women were also carrying children for the couple. State and federal investigations are ongoing.
Schweizer suggests that Xuan and Zhang's operation is unlikely to be an isolated phenomenon. Citing California state records, he noted that there are 107 companies with the term "surrogacy" in their names, all owned by Chinese nationals.
