“There was news that 99 Chinese nationals who were at the National Election Commission training center in Suwon were taken to a US military base in Okinawa, investigated, and confessed to election fraud. If the US investigated this, they would announce it now. The state of emergency martial law was to reveal this, but I have extreme doubts about calling it a subversion of the constitution and a reason for the president's resignation.”

As news about the truth of election fraud from the US emerges one after another, the statements made by lawyer Bae Jin-han, who represented President Yoon Suk-yeol in last year's Constitutional Court impeachment trial, are drawing renewed attention regarding election fraud.

Hanmiilbo recently obtained a video of lawyer Bae's related remarks, coinciding with US President Donald Trump's emphasis on "If we cannot stop election fraud, the nation cannot exist," and released it on their YouTube channel on the 6th.

Martial Law: The Last Resort to Identify Election Fraud

Lawyer Bae, one of President Yoon's legal team, mentioned the "Arrest of Chinese Spy Ring Related to NEC Training Center" case by Skydaily during last year's trial (the 11th hearing, final statement, Constitutional Court impeachment trial, 2025.2.25) and stated, "The President's declaration of martial law was a measure taken with the firm conviction that the current situation is a national emergency" (Reporter Heo Gyeom, who wrote Skydaily's article on the Chinese spy ring, is currently founding and working at Hanmiilbo).

Lawyer Bae stated, "The President knew that martial law was an emergency power granted to the president by the constitution. The Supreme Court's precedents have already ruled that judgments made at the president's discretion are not subject to judicial review, so he declared martial law after sufficient deliberation and based on his own judgment. I do not understand why the president who exercised his authority is being arrested."

He also continued to brief on why the president had no choice but to judge the situation at the time as a national emergency.

Lawyer Bae explained, "The first major subversion of the constitution was due to election fraud. During his tenure, the president received a great deal of reports about election fraud, and there were indeed many aspects that were suspected of being fraudulent elections. It is the president's duty to reveal suspicions of election fraud that shake the foundation of democracy."

He explained that even if the president did not have a firm conviction about election fraud, it was his duty to investigate if there were suspicions. He further clarified that if the president clearly recognized election fraud, there would be no need to declare martial law to find evidence.

He also emphasized, "Martial law was declared because the public had suspicions and there were sufficient reasons for those suspicions."

Lawyer Bae also described the unfortunate situation where evidence of election fraud could not be secured during peacetime, necessitating the search for evidence through martial law.

He stated, "In the latter half of last year, there were cyberattacks from North Korea against constitutional bodies and government agencies, including the National Election Commission. I believe the National Assembly's investigation team is also aware of this. After discovering this, the National Intelligence Service attempted to inspect all government agencies for information leakage and the security of their IT systems."

He continued, "All government agencies cooperated. However, despite the president's announcement of a statement on October 12 last year, the National Election Commission, claiming to be a constitutional body, flatly refused, and the investigation ultimately failed."

Following that was the 'Large-scale illegal hiring incident at the National Election Commission.'

Lawyer Bae criticized, "Can children get hired just because their fathers work at a government agency? The National Election Commission is a truly omnipotent government agency."

He then expressed his indignation, saying, "After the large-scale illegal hiring incident, the National Election Commission also relented and underwent inspection by the NIS. However, the NIS inspection revealed suspicions everywhere, and they requested additional server submissions. But the National Election Commission did not comply with any of the NIS's requests."

He pointed out, "The public's suspicions about election fraud have been around for years. Therefore, to prevent national division, the National Election Commission, as a state agency, should have naturally taken the lead in resolving these suspicions. Their failure to do so ultimately led to this situation."

He then began to enumerate the suspected circumstances of election fraud one by one.

Possibility of Hacking and Manipulation of Vote Counting and Tabulation

“Even with the basic system inspection conducted by the NIS, first, the possibility of overall manipulation of hacking and vote counting and tabulation was discovered. The National Election Commission's system is vulnerable to attacks such as external network intrusion, and it is easy for hackers from within the country, as well as from China and North Korea, to access it, with a high probability of overall manipulation of vote counting and tabulation data.”

Lawyer Bae lamented, "However, since the introduction of the early voting system, it has become impossible for courts to secure evidence. It is impossible to know how many people voted, and filing an election nullification lawsuit afterwards has become meaningless."

“I don't know how such a system came into being. In the past, with absentee ballots, there were ledgers indicating how many people voted. Therefore, it was possible to confirm with the individual whether they had voted or not. But now, we cannot know who voted or how many people voted. How can such a system exist?”

He then criticized, "Therefore, if anyone intends to gain any advantage from this, it has become possible to enter the server and falsely manipulate records to show that they voted."

“As seen in many videos, the ballot boxes appear to have locks, but black paper is placed over them, designed to be removed from both sides later. This means they can be opened at will and any number of ballots can be inserted. Who would do such a shoddy job, and why? A philosopher once said, ‘There is no action without purpose.’ What purpose could have led to such an action?”

Election Manipulation Through Inflation of Early Voting Numbers

Lawyer Bae presented his second suspected circumstance of election fraud: manipulation of election results through the inflation of early voting numbers.

“As I mentioned earlier, there is no way to confirm inflation, and there are no court proceedings. The current integrated voter registry system, which manages voter registration status and voting status, can mark someone who voted early as not having voted, or someone who did not vote as having voted. Phantom voters can emerge. How can this be possible when every single vote from the citizens is so precious?”

Lawyer Bae raised his voice, stating, "The National Election Commission responds by not providing explanations and only asserting 'we are legitimate.' If the president is not angered by this, he is unfit for his position."

He also raised suspicions about the unauthorized printing of early voting ballots that are identical to actual early voting ballots with QR codes.

“The printing of unauthorized early voting ballots is possible because the file for the stamp used on early voting ballots and the test printing program are not strictly controlled. Unauthorized PCs can be connected to the communication equipment installed at early voting stations… Anyone familiar with machinery will understand. The current election system allows unauthorized intrusion into the internal election network from the outside to manipulate vote counting and tabulation data.”

He argued that the many Chinese hackers would not be idle, and North Korea is even more so.

“Of course, it's not just people in those countries who are hacking; hackers spread across the globe can access this and create the necessary votes. Hackers can alter the vote counting results at will due to loopholes in the voting system, such as ballot sorters, and the insufficient security management of the vote tabulation system where the results are stored.”

He stated, "It has been confirmed that hackers could alter the results of ballot sorting by connecting external devices like USB drives due to poor management of ballot sorters, and even by connecting wireless communication devices. Is a system password of 12345 acceptable?”

“Those who deny election fraud may say that such things are possible. However, when coincidences repeat themselves, do they not become inevitable? The system password 12345, beyond being lax, is the key connecting central and local governments. It appears to have been created to allow access from countries like China.”

He emphasized that elections are the foundation of democracy and that every precious vote of the citizens must be protected, even if it requires investing a significant portion of the national budget.

Security Equipment Manufacturer is Ssangbangul, the Entity Involved in Remittances to North Korea

Regarding the security management company and its equipment manufacturer, he stated, "The company managing the security of the election system, which determines the nation's destiny, is a very small company with insufficient expertise. Furthermore, the equipment manufacturer is Ssangbangul, the entity responsible for the $8 million (approximately 11.7 billion KRW) remittance to North Korea." He added, "The fact that a company involved in remittances to North Korea manufactured equipment through its affiliates leads us to suspect that 'when coincidences pile up, it becomes inevitable.'"

“Even without definitive proof, the president harbored strong suspicions about this matter. The Board of Audit and Inspection's investigation revealed over 1,200 violations of the National Election Commission's procedural regulations over the past decade, with 400 in the central government and 800 in local governments. A full investigation into experienced hires also found that 100% of nepotistic hires were illegal. The Director of the Board of Audit and Inspection lamented that this was the first time he had seen such an institution. I believe this is an area that the judges should pay close attention to.”

Lawyer Bae expressed his opinion that election fraud in Korea is significantly related to China.

He listed countries that imported Korea's electronic voting and vote counting equipment, including Kyrgyzstan, Congo, Bolivia, South Africa, Belarus, Iraq, Belarus, Myanmar, Mozambique, El Salvador, Fiji, Ecuador, and the Philippines, stating that there are actually more. The commonality among these countries is that they are all Belt and Road Initiative target countries of China.

“These countries are heavily influenced by China, and it was with China's help that Korea could export its equipment. Kyrgyzstan, which imported Korean equipment, experienced protests over election fraud, resulting in the burning of the presidential palace and the president's resignation.”

He reported, "Congo, which experienced bloodshed related to election fraud, protested to the Korean National Election Commission asking how such equipment could have been exported. Bolivia's president resigned after bloodshed, and South Africa and Belarus also experienced bloodshed. In Iraq, a 12-fold difference between manual and electronic vote counts occurred, with election manipulators winning 25% of the seats.”

“Belarus experienced a severe protest movement for the president's resignation, leading to a violent situation. The Philippines ruled against the use of Smartmatic. All of this has been reported in the newspapers. We are not speculating; this has all been publicly disclosed in the news.”

Lawyer Bae did not stop there and also cited examples of fraudulent ballots related to election fraud: △ Rising Sun Flag ballots (the stamp was smudged like a rising sun flag) △ Cabbage Leaf ballots (two ballots were printed together) △ Magnetic ballots (adhered with glue) △ Shape Memory Paper (stiff without any sign of folding).

Regarding shape memory paper in particular, he added, "Physicists say such paper could win a Nobel Prize. That is impossible. Our election manual states that we fold the ballot paper before inserting it into the ballot box, but China and North Korea insert them unfolded."

Reason for Deploying More Troops to the National Election Commission Than the National Assembly

“Fair and transparent elections are the core of democracy. Democracy cannot be properly realized if the people do not trust the election results. Despite this, the National Election Commission refused a full inspection. As a result, to thoroughly resolve the public's suspicions of election fraud, the president deployed more troops to the National Election Commission (300 personnel) than to the National Assembly (270 personnel) during the period of martial law.”

Lawyer Bae stated, "In fact, if the intention was to maintain martial law, 1,000 or even 5,000 troops would have been deployed to the National Assembly. However, the president deployed 270 personnel to the National Assembly, and even those were unarmed soldiers deployed solely for maintaining order. But 300 personnel were sent to the National Election Commission. This was an unavoidable choice to thoroughly examine the omnipotent IT system of the National Election Commission and establish the foundation of democracy."

“While it wasn't a major newspaper, there was news that 99 Chinese nationals at the Suwon training center were investigated at a US military base facility in Okinawa and confessed to election fraud.
