Trump mentions retrial of tariff ruling... "Countries and companies exploiting the US have made a fortune"

U.S. President Donald Trump mentioned a rehearing of the Supreme Court's ruling that declared certain tariffs illegal.


In a post on his social media platform Truth Social on the 27th (local time), President Trump expressed concern that "the recent Supreme Court decision on tariffs could allow hundreds of billions of dollars to be returned to countries and companies that have been 'exploiting' America for years."


Tariffs are paid by U.S. importers, and President Trump argued that if previously paid tariffs are refunded through lawsuits, the money would go back to foreign countries and foreign companies.


President Trump added, "Now, according to this decision, they can actually continue those practices (exploiting America) at a higher level."


President Trump emphasized, "I'm sure the Supreme Court did not have this in mind."


He argued, "It makes no sense that countries and companies that have been taking advantage of us for decades, receiving billions of dollars (such as government subsidies) that should not have been allowed, would be entitled to an unprecedented and unfair 'windfall' in the world as a result of this ruling, which is disappointing at the very least."


He then asked, "Is a rehearing or readjudication of this case possible?"


President Trump's remarks appear to be in response to the numerous lawsuits seeking tariff refunds faced by the federal government following the ruling that certain tariffs were illegal. The total amount sought for tariff refunds is estimated to be between $133.5 billion (approximately 193 trillion won) and $175 billion (approximately 254 trillion won). U.S. media reports indicate that at least 1,800 companies have filed lawsuits seeking refunds.


The 'rehearing' procedure mentioned by President Trump is stipulated in Rule 44 of the Supreme Court's rules.


An application for rehearing must be filed within 25 days of the entry of the judgment or decision. The Supreme Court's ruling on the 20th, with a vote of 6 in favor and 3 against, declared that the imposition of certain tariffs under the International Emergency Economic Powers Act (IEEPA) was illegal. As a rehearing requires a majority vote in favor, based on the proposal of a justice who agreed with the ruling, the possibility of it actually being proposed and succeeding does not appear high.
