The U.S. Supreme Court heard oral arguments on March 23 (local time) regarding challenges to mail-in ballots.
The lawsuit, which challenges the validity of mail-in ballots, was filed by the Republican National Committee and the Mississippi Libertarian Party. Conservative Justice Samuel Alito fiercely criticized the endless counting of mail-in ballots.
Justice Alito said, "There are many two-word phrases where the second word is 'Day', such as Labor Day, Memorial Day, George Washington's Birthday, Independence Day, Birthday, and Election Day."
"All of these are specific days. So when you see the phrase 'Election Day,' it seems to me that the day on which everything is supposed to happen is that day," he added.
CBS News reported, "Chief Justice John Roberts and Justice Amy Coney Barrett posed questions expressing concern about how a ruling invalidating the deadline for late-arriving ballots would affect other election rules, including those allowing early voting. The Republican National Committee and the Trump administration have argued that under federal law, which sets a uniform election day for presidential and congressional elections, the day the ballot is cast is the Election Day."
The Supreme Court is expected to issue a ruling on the case in June.
Recently, the Fifth Circuit Court of Appeals ruled in the Mississippi case that "counting ballots that arrive after Election Day may violate federal law."
The lawsuit is expected to affect 13 states, including Mississippi.
