It was revealed on the 10th that the Incheon Yeonsu Police Station’s Intelligence Crime Investigation Team decided on the 29th of last month not to forward the case against former lawmaker Min, who had been accused of defamation under the Act on Promotion of Information and Communications Network Utilization and Information Protection.

They concluded, "Given the precedent set by the Seoul Western District Court (2014Godan1305), which deemed the expression 'posing as an elected official through fraudulent election' to be evaluative in nature, and the precedent (Seoul Central District Court 2014Gohap382) where election disobedience movements were only judged as guilty when specific false facts were presented, it is difficult to view the suspect's statements in his YouTube broadcast as the assertion of false facts." 

In a phone call with Hanmi Ilbo on the 10th, former lawmaker Min said, "I received written notification of the police's decision to clear me of charges today," adding, "During my police questioning and subsequent supplementary investigation, to prove my innocence, I presented the work of Professor Emeritus Heo Byeong-ki of Inha University’s College of Engineering, who scientifically proved that this election yielded anomalous results that are statistically impossible to explain, with the help of attorney Kwon Oh-yong. I am pleased with the positive outcome." He added, "I want to share this small but precious victory with my many patriotic comrades." 

Previously, former lawmaker Min was reported for defamation on February 10 after stating on YouTube that "a significant number of Democratic Party lawmakers are fake representatives elected through fraudulent elections."
