The released photo shows President Lee holding an unfolded ballot and asking an election official outside the voting booth for clarification. Kyunghyang Shinmun also reported that President Lee pointed to the ballot and asked about its marked status and whether it was invalid.
The photo is physical evidence that an unfolded ballot was presented outside the voting booth, and the article content is circumstantial evidence supporting that the ballot was cast.
The issue is simple: does the act of showing a cast ballot, unfolded, to an election official outside the voting booth constitute a "publicly disclosed ballot" under the Public Official Election Act?
The Law Prohibits the Disclosure of "Marked Ballots"
Article 167, Paragraph 3 of the Public Official Election Act stipulates that an elector cannot publicly disclose their marked ballot, and a publicly disclosed ballot shall be deemed invalid. The law does not base its judgment on "who actually saw the contents of the mark." It asks whether "one's own marked ballot" was disclosed.
Therefore, whether the candidate marked was identifiable is not the essential criterion. The issue is that a marked ballot was presented in a state where a third party could see it, unfolded.
The Election Commission's Standard in the Previous Presidential Election Was "Showing It Makes It Invalid"
The Election Commission's guidelines in the previous presidential election were the same.
Ahead of the 21st Presidential Election's early voting, the Seoul Metropolitan Election Commission announced that if an elector brings a marked ballot out of the voting booth and shows it to the election manager, it will be considered a publicly disclosed ballot under Article 167 of the Public Official Election Act and will be invalidated.
The Ulsan Metropolitan Election Commission also stated that showing a marked ballot to the election manager would render it a publicly disclosed ballot and thus invalidate it.
According to this standard, the conclusion is clear.
The publicly released photo confirms that President Lee Jae-myung took an unfolded, marked ballot outside the voting booth and presented it to an election official. Kyunghyang Shinmun's fact-check missed this core point. Kyunghyang Shinmun, citing an anonymous election commission official, published a headline stating, "No problem if there's no intent."
However, intent can only be a secondary factor considered in cases of accidental exposure, such as accidentally dropping a ballot. In cases like this, where a marked ballot is taken out unfolded, the first thing to consider is whether it was disclosed.
The interpretation of the Public Official Election Act and its enforcement regulations hinges on the state of disclosure, not on intent. If it is deemed a publicly disclosed ballot, it is invalid. The explanation of no intent cannot be a basis for overturning the legal provision that invalidates publicly disclosed ballots.
"You Shouldn't Show It" Is Not a Basis for "No Problem"
Furthermore, Kyunghyang Shinmun's article also includes a statement from the on-site early voting manager telling President Lee, "You shouldn't show it."
This statement is not a basis for claiming there is no problem. Rather, it confirms the election management principle that marked ballots should not be shown.
It can be seen as a warning issued because the unfolded ballot was already outside the voting booth. The problem is that the warning was not enough. What the Election Commission should have done was invalidate the ballot as a publicly disclosed one.
Overall Verdict
The verdict of this fact-check is clear.
Based on the photo and the article content, it is confirmed that President Lee's ballot was publicly disclosed outside the voting booth in an unfolded state after being marked. The photo is physical evidence, and Kyunghyang Shinmun's article content is circumstantial evidence supporting that it was a post-marking ballot.
Article 167, Paragraph 3 of the Public Official Election Act stipulates that publicly disclosed ballots are invalid. The Election Commission's disclosure standards from the previous presidential election also guided that if a marked ballot is brought out and shown to the election manager, it is considered a publicly disclosed ballot and will be invalidated.

투표도 똑바로 못하는 가짜 대통령답다
재검표 과정에서 중국에서 만든 투표지인지는 확실치 않지만 기표인이 조잡하게 변형된 투표지들이 무더기로 쏟아져 나온 것에 대해 변명이라도 할 요량으로 이재명 자신처럼 기표인이 반만 찍힌 투표지도 정상적인 투표과정에서 나올 수 있다는 것을 직접 보여 주기위해 일부러 기표인을 반만 찍고 나서 그대로 들고 나와 공개한 듯.
하지만 재검표 과정에서 나온 괴상한 투표지들이 중국에서 만든 투표지인지는 확실치 않지만 정상적인 투표과정에서 나올 수있는 반만 찍힌 기표인이 아니라 인영이 찌그러진 것도 있고 타원형인 것도 있고 누가 보더라도 정상적인 기표과정에서는 나올 수 없는 조잡한 투표지임을 알 수있는 것인데도 법관들이 조작된 투표지들로 인정하지 않아서 우리 사법체계 안에서 부정선거를 바로 잡지 못하고 계속해서 중국 공산당 등에 의해 선거결과가 좌우되는 요지경 세상이 되어버렸다.
이재명이 대통령 놀이에 재미라도 들린 듯 대통령이 찍은 투표지도 정상이 아닌 것처럼 치부될 수 있다고 호도하면서 시연한 듯하나 재검표과정상 기형적인 투표지들은 이재명이 공개한 반만 찍힌 투표지와는 달라도 많이 다르다.
이재명이 진짜 국민들이 뽑아준 대통령것처럼 행세하는 공식석상에서의 행동이 시진핑이나 김정은이처럼 뭔가 자연스럽지 못하고 어색하고 이상해보인다는 점을 이재명이는 알랑가 모르겠다.
