The constitutional appeal filed by Lee Jin-sook, former Chairperson of the Korea Communications Commission (KCC), against the Broadcasting Media Communications Commission (BMCC) Act, which abolished the KCC and established a new organization, will be formally judged by the Constitutional Court.
According to legal circles on the 17th, the Constitutional Court officially referred the constitutional appeal for confirmation of unconstitutionality of Article 4 of the supplementary provisions of the BMCC Act, filed by the former Chairperson Lee, to formal adjudication on the 15th.
Under the Constitutional Court Act, the Constitutional Court determines whether a constitutional appeal meets the legal requirements through a designated panel composed of three justices. If the designated panel determines there are no legal defects, it is referred to the full bench for deliberation by nine justices.
Article 4 of the supplementary provisions of the BMCC Act stipulates the succession of former KCC employees to the BMCC, stating that "political appointees are excluded."
Former Chairperson Lee argued that the provision shortened her legally guaranteed term until August of next year, infringing upon her rights to equality, pursuit of happiness, and public office, and accordingly filed for a constitutional appeal and a provisional disposition to halt its effect on the same day.
As the BMCC Act, passed by the National Assembly on the 27th of last month, took effect on the 1st of this month, the former KCC was abolished and the BMCC was launched. Former Chairperson Lee was also dismissed on the same day according to the law.
