A dedicated visa channel for South Korean companies investing in the United States was officially opened at the U.S. Embassy in Seoul on the 5th.
The short-term business (B-1) visa issued through this channel will specify the residency status of Korean workers and information on the projects they are undertaking. It is expected to enhance the stability of stay for Korean businesspeople, as large corporations will be able to apply for visas collectively for their partner companies' personnel.
This measure is a result of the South Korea-U.S. Visa Working Group's efforts, following the mass detention of Korean workers in Georgia, U.S., in September.
The Ministry of Foreign Affairs announced that Kim Jin-a, the Second Vice Minister, visited the dedicated desk for Korean investment companies (KIT Desk – Korean Investment and Travel Desk) established at the U.S. Embassy in Seoul today to review the outcomes of the Visa Working Group's discussions and future plans with Kevin Kim, the Chargé d’Affaires of the U.S. Embassy in Korea.
The KIT Desk, a dedicated visa channel for companies investing in the U.S., commenced its pilot operation in October and officially launched today. It operates through collaboration between the U.S. Department of State, Department of Commerce, Department of Homeland Security, and Customs and Border Protection (CBP).
A meeting space has been prepared at the U.S. Embassy in Seoul, and dedicated personnel will conduct individual meetings with major U.S. investing companies such as Samsung, Hyundai Motor, SK, LG, and Hanwha. Partner companies of these corporations can also utilize the desk.
Specifically, when issuing B-1 visas, the remarks section can include information on residency status as a worker under relevant U.S. regulations, and details about which company's factory and what project they will be working on.
This is a special measure applied only to South Korea, which is expected to reduce the likelihood of issues during entry inspections and assist in proving residency status in the event of immigration crackdowns.
Furthermore, the KIT Desk allows large corporations to apply for visas collectively for their entire travel contingent, including their partner companies.
Previously, companies had to apply for visas separately. Large corporations generally obtained secure visas like E-2 or L visas, experiencing few major issues.
However, employees of partner companies often faced difficulties in preparing individual supporting documents, and were more frequently subjected to visa denials or entry refusals. These challenges are expected to be significantly alleviated.
The U.S. Embassy stated, "The launch of the KIT Desk underscores the Embassy's commitment to actively welcoming and encouraging South Korean investment in the U.S. to support America's re-industrialization, strengthen the ROK-U.S. alliance, and promote shared prosperity."
The U.S. has also guaranteed that employees detained in Georgia will not face any disadvantages when re-entering the U.S. Those who previously received B-1 visas can continue to use them, and workers entering under the visa waiver program's Electronic System for Travel Authorization (ESTA) are being assisted in obtaining B-1 visas promptly.
The government plans to establish cooperation channels with local customs in cities with a high influx of Korean workers, such as Los Angeles, Chicago, and Atlanta.
The U.S. has also published explanatory materials in Korean and English detailing the scope of activities permitted within the U.S. under B-1 visas and ESTA, and posted them on the U.S. Embassy in Seoul's website.
Previously, during meetings of the Visa Working Group with South Korea, the U.S. reaffirmed that Korean companies could utilize B-1 visas for activities such as installation, servicing, and repair of overseas purchased equipment accompanying their U.S. investments, and that similar activities are permissible under ESTA as for B-1 visa holders.
However, it is understood that further consultations are required regarding the specific scope of activities.
The government plans to continue pursuing the establishment of a dedicated visa for Korean nationals.
This is a legislative matter and cannot be accomplished solely through the will of the U.S. administration.
A source from the Ministry of Foreign Affairs stated, "There were limitations as amending laws in the U.S. is a political issue requiring congressional approval beyond the executive branch's jurisdiction."
He added, "We have agreed to continue holding the working group next year and will maintain diplomatic efforts towards the U.S. Congress."
