On Tuesday, the 31st, the U.S. Supreme Court overturned a Colorado state law that banned so-called "conversion therapy" aimed at helping minors align their "gender identity" with biological reality, ruling it unconstitutional by an overwhelming majority.
The Supreme Court dismissed the law by an 8-1 vote, stating that allowing some views while disallowing others is highly likely to infringe upon freedom of expression guaranteed by the First Amendment.
Justice Neil Gorsuch emphasized that the First Amendment acts as a shield, preventing the government from compelling specific thoughts or expressions, and pointed out that the law sought to regulate the speech itself, rather than the professional conduct of counselors.
Justice Ketanji Brown Jackson, a progressive justice who previously caused controversy for her inability to provide a clear definition of what a woman is, was the sole dissenter in this ruling.
Conversion therapy is the opposite concept of gender reassignment surgery, seeking to align one's sexual orientation or identity with their physiological sex (body) and employs psychological methods such as counseling, prayer, and aversion therapy.
Colorado's law prohibits outdated and unethical aversion therapies historically associated with conversion therapy, such as electroshock therapy, while more broadly banning "the act of providing professional services with the goal of changing an individual's sexual orientation or gender identity, i.e., an attempt to change one's behavior or expression, or to reduce sexual or romantic attraction or feelings toward people of the same sex."
Colorado's law was passed in 2019, and 23 states have implemented laws banning "conversion therapy." With the Supreme Court's ruling today, the prohibition laws in these states are facing the risk of being suspended or challenged legally.
Currently, states that have a complete ban on conversion therapy include: California, Oregon, Washington, Nevada, Utah, Colorado, New Mexico, New York, New Jersey, Connecticut, Massachusetts, Rhode Island, Vermont, New Hampshire, Maine, Delaware, Maryland, Illinois, Minnesota, Michigan, Hawaii, Virginia, Kentucky.
States that have partial regulations through governor's executive orders or specific funding restrictions, rather than statutory law, include: Arizona, North Carolina, Pennsylvania, Wisconsin, Puerto Rico.
This ruling is the latest in a series of instances where the 6-3 conservative-majority Supreme Court has curbed the overreach of transgender activists who have prioritized gender identity over biological reality in all areas for over a decade.
Last June, the Supreme Court ruled that a Tennessee law banning gender reassignment surgery for minors was constitutional, dealing a significant blow to transgender activists who advocate for LGBTQ+ propaganda in schools.
The Supreme Court is expected to soon rule on whether transgender men (biological males) should be allowed to dominate women's sports and spaces. In January, the Supreme Court heard oral arguments regarding two laws enacted in West Virginia and Idaho to protect women's and girls' sports from the intrusion of male athletes.
