The world has been thrown into shock after U.S. President Donald Trump moved to fully implement even more powerful substitute tariffs following the U.S. Supreme Court’s decision to put a brake on reciprocal tariffs.
In a press conference held at the White House immediately after the Supreme Court ruling on the 20th (local time), President Trump signed an executive order imposing an additional 10% tariff on the entire world, based on Section 122 of the Trade Act.
He stated, "We are imposing temporary import tariffs as part of the administration's ongoing efforts to resolve fundamental international payment issues and rebalance trade relationships for the benefit of American workers, farmers, and manufacturers."
With this, the U.S. government will impose a 10% tariff on goods imported into the U.S. for the next 150 days. This measure will take effect at 12:01 AM on the 24th.
Regarding the Supreme Court's earlier ruling that day, he rebuked the court on Truth Social, stating, "The Supreme Court decision on tariffs is very disappointing! I am ashamed of the justices on the Supreme Court who lack the courage to do what is right for the United States." He added, "I want to thank and congratulate Justices Thomas, Alito, and Kavanaugh. If you read their dissenting opinions, no one can argue with them."
He continued his tirade, saying, "Foreign countries that have been plaguing the U.S. for years are dancing in the streets in ecstasy, but they won’t be dancing for long!" He further lashed out, "The Democrat (left-leaning) justices must be happy, and they will rubber-stamp votes against everything that makes America strong and healthy again, but they have brought disgrace upon the United States."
On the other hand, he noted that "this Supreme Court ruling did not weaken the President's authority to regulate trade and impose tariffs, but rather made it stronger and clearer." He pointed to the paradox of the ruling, stating, "While the Supreme Court limited the use of IEEPA, it confirmed that the executive branch's trade-related powers are much broader."
President Trump emphasized that legitimate and powerful alternatives, which the judiciary has accepted in the past, remain available, stating, "It is good news that both the Supreme Court, in making this terrible ruling, and Congress acknowledge that there are means, methods, regulations, and authorities more powerful than tariffs under the International Emergency Economic Powers Act (IEEPA, enacted in 1977)." Specifically, he focused on Section 232 of the Trade Expansion Act, Sections 301 and 122 of the Trade Act, and Section 338 of the Tariff Act.
In this regard, he affirmed his intention to forge ahead with his "killing rogue states" strategy based on America First, stating, "I will now utilize other alternatives to replace the measures the Supreme Court unfairly rejected. All national security tariffs under Section 232 and existing Section 301 tariffs will remain in full force and effect immediately."
While the U.S. Supreme Court ruled that the tariffs President Trump imposed globally using IEEPA were unlawful, stating that "IEEPA does not grant the President the authority to impose tariffs," U.S. government officials believe there is virtually no way for the Supreme Court to block the other tools, as the judiciary has long recognized Section 232 of the Trade Expansion Act, Sections 301 and 122 of the Trade Act, and Section 338 of the Tariff Act as the President's inherent authority.
U.S. Treasury Secretary Scott Bessent also predicted that the administration would utilize these alternative measures and that tariff revenue would be maintained throughout the year as a result.
