U.S. President Donald Trump announced on the 21st (local time) that he would raise the "global tariff," which he had previously vowed to impose on the entire world following the U.S. Supreme Court's ruling against his reciprocal tariffs, from 10% to 15%.
This move is interpreted as a demonstration of his resolve to maintain high-intensity tariff policies by mobilizing all available alternative measures despite the Supreme Court's intervention.
President Trump stated on the social media platform Truth Social that day, "Effective immediately, I will be raising the 10% Worldwide Tariff to the maximum legally permitted level of 15%."
He further wrote that many countries around the world "have been 'ripping off' the United States for decades without any retaliation (until I came along!)."
President Trump explained that this decision was made "based on a thorough, detailed, and complete review of yesterday's ridiculous, poorly written, and extremely anti-American Supreme Court decision on tariffs."
He added, "In the coming months, the Trump administration will determine and announce new, legally permissible tariffs," noting that "this will allow us to continue our incredibly successful 'Make America Great Again' process."
The previous day, the U.S. Supreme Court ruled that the reciprocal tariff measures imposed by President Trump on various countries, which were based on the International Emergency Economic Powers Act (IEEPA), were unlawful.
In response, President Trump signed an executive order to impose a "10% global tariff" on all countries based on Section 122 of the Trade Act, signaling his intent to maintain his tariff policy through alternative means.
With the subsequent announcement to raise the global tariff rate to 15%, additional measures such as follow-up executive orders are expected to follow.
Section 122 of the Trade Act grants the President the authority to impose tariffs of up to 15% for a maximum of 150 days to address balance-of-payments issues. To continue these measures beyond 150 days, Congressional approval for an extension is required.
In addition, President Trump plans to utilize Section 232 of the Trade Expansion Act and Section 301 of the Trade Act to replace existing reciprocal tariffs and other measures.
Section 232 of the Trade Expansion Act grants the President tariff authority if it is determined, through an investigation by relevant departments, that imports of specific items threaten national security. It is already being used to impose tariffs on various items, including automobiles and steel.
Section 301 of the Trade Act allows the President to take retaliatory measures, such as tariffs, against trading partners that engage in unfair and discriminatory trade practices against the United States, following a period of notification and public comment.
