Activists supporting President Donald Trump are reportedly working with the White House to circulate a 17-page draft executive order alleging Chinese interference in the 2020 election, arguing that such findings could justify declaring a national emergency, according to a report by The Washington Post on the 26th (local time).
The draft executive order would grant President Trump broad authority to take action regarding federal election procedures if evidence of foreign interference is confirmed, the report stated.
Measures discussed by supporters include restrictions on mail-in ballots and voting machines, which they claim can be exploited as pathways for external interference.
President Trump has repeatedly emphasized the need to strengthen voter identification requirements and enhance controls over mail-in voting ahead of upcoming elections.
In early March 2025, during his second term, President Trump outlined an "Executive Order Protecting the Integrity of American Elections" via a White House fact sheet. This order would include measures such as requiring proof of citizenship for voter registration, prohibiting mail-in voting except in exceptional cases, invalidating mail-in ballots arriving after Election Day, mandating the use of paper ballots, and requiring voters to present identification to cast a ballot.
Subsequently, Congress introduced bills like the SAVE Act, the SAVE America Act, reflecting these proposals.
The House of Representatives approved these bills, but their passage in the Senate remains uncertain due to strong opposition and filibustering by Democrats.
According to The Washington Post, the activists leading the push for these bills believe that if Congress fails to act, their proposals could influence broader executive actions.
The White House declined to comment on specific plans but stated that the President regularly receives policy proposals from outside experts.
White House spokesperson Abigail Jackson told The Washington Post, "President Trump is committed to ensuring the American people have full confidence in election administration, including having completely accurate and up-to-date voter rolls without errors or non-citizen voters registered illegally."
"The President has urged Congress to pass the SAVE Act and other legislation that would establish uniform standards for photo identification to vote, prohibit no-excuse absentee voting, and end ballot harvesting practices," she added.
Florida lawyer Peter Ticktin, a proponent of the draft executive order, told The Washington Post, "Under the Constitution, the legislature and the states have substantial control over how elections are run, and the president has no authority whatsoever over this."
"However, here we have a situation where the president is aware that foreign powers are interfering with our election process," he continued. "This creates a national emergency that the president must address."
Article I, Section 4 of the Constitution assigns the responsibility for regulating elections to the states and Congress. Legal experts point out that any attempt to enact widespread federal election changes through an executive order would almost certainly face immediate legal challenges.
A "2021 U.S. intelligence community review" released in March 2021 during the Biden administration concluded that China considered efforts to influence the 2020 election but did not execute them.
However, Trump has continued to cast doubt on the 2020 election results and has stated that additional measures may be necessary to restore public confidence in the electoral system. His claims have served as a cornerstone in galvanizing his MAGA base and growing his influence over the Republican establishment.
In a statement to Newsmax, a White House spokesperson said, "White House staff regularly communicate with various outside supporters who wish to share policy ideas with the President. Speculation about policies the President may or may not announce is just that – speculation."
