A coalition of 24 states, led by Democratic attorneys general from Arizona, California, New York, and Oregon, has filed a lawsuit challenging President Donald Trump's newly imposed import tariffs.
The lawsuit, filed on the 5th (local time), comes just days after the administration was dealt a blow when the Supreme Court invalidated separate tariffs imposed under the International Emergency Economic Powers Act.
On the same day the Supreme Court issued its ruling on the International Emergency Economic Powers Act (IEEPA), President Trump announced a new tariff regime, imposing a 10% tariff on most imports worldwide. He cited Section 232 of the Trade Expansion Act of 1962 as the legal basis for these tariffs.
The following day, the President announced his intention to raise the tariff rate to 15% via a post on Truth Social.
In their lawsuit filed with the U.S. Court of International Trade, the states argue that the President's proclamation under Section 232 exceeded his legal authority and violated the constitutional principle of separation of powers. The plaintiffs asserted in their filing that the action was an overreach and an unprecedented abuse of Section 232.
The plaintiffs contend that, similar to the International Emergency Economic Powers Act (IEEPA), this provision has not been used for imposing tariffs in the past, and that the statute does not authorize the broad international trade restrictions announced by the administration.
The next step now rests with the federal government, which is expected to respond with either a brief or a motion to dismiss.
