Amidst a deadlock in the Senate over the "SAVE America Act" and Department of Homeland Security funding, proposals are emerging that suggest a pathway to pass the legislation and bypass a Democratic filibuster.

House Homeland Security Committee Chairman Mark Green (R-Wis.) has introduced a bill that would provide federal tax credits to states that implement voter ID laws and require proof of citizenship for voter registration, the Washington Examiner reported on Tuesday.

The Safeguarding American Vote Eligibility Act, introduced by Rep. Green, aims to mandate these requirements in all states.

According to documents obtained by the Washington Examiner, Green's bill also includes provisions to provide grants to states for conducting post-election audits, improving infrastructure to speed up vote counting, and sharing voter data with federal agencies and other states.

Currently, the "SAVE America Act" lacks the 60 votes needed to overcome a Senate filibuster.

Senators have proposed a package of a compromise bill that could prioritize funding for Immigration and Customs Enforcement (ICE) operations and include some elements of the "SAVE America Act."

President Donald Trump has indicated his willingness to accept a $5 billion cut to ICE funding in exchange for the passage of the "SAVE America Act," highlighting his intent to leverage budgetary disputes for broader policy changes.

Reconciliation is a special Senate procedure that allows certain tax and spending matters to pass with a simple majority instead of the usual 60 votes needed to overcome a filibuster, but it is limited to provisions related to the budget.

Tom Bevan, co-founder and president of RealClearPolitics, said in an interview with Newsmax on Tuesday that while the budget reconciliation process is limited, it can be used in this instance.

"This is a procedural strategy that the Senate can use to avoid a filibuster," he said. "If the bill is related to budget or fiscal matters, the Senate can pass the bill."

The budget reconciliation process involves four steps: adoption of a budget resolution, committee-specific bill drafting, consolidation by the Budget Committee, and floor vote and approval.

Last year, Congress used the budget reconciliation process to advance President Trump's tax cut legislation, the "One Big Beautiful Bill" (OBBBA).

This process was also used for the Biden administration's Inflation Reduction Act (IRA, 2022) and American Rescue Plan Act (ARP, 2021).

However, for the Save America Act to be processed through budget reconciliation, its nature as a policy issue concerning "election administration (voter eligibility, etc.)" versus a fiscal issue with direct "federal budget (spending/revenue)" implications is crucial.

This is known as the "Byrd Rule," and the final determination on this matter is made by the Senate Parliamentarian, not by members of Congress.

The current Senate Parliamentarian is Elizabeth MacDonough, who was appointed in 2012 by then-Senate Majority Leader Harry Reid.

In the past, during the Biden administration, she ruled against the Democratic Party's attempts to include proposals for raising the minimum wage and immigration reform in budget reconciliation bills, deeming them "non-germane" and blocking them.

Therefore, the Republican lawmakers' efforts to pass the Save America Act through budget reconciliation will ultimately depend on the interpretation of Parliamentarian MacDonough.
