South Korea's democracy has been tragically undermined. The National Election Commission (NEC), responsible for election administration, has deprived sovereign citizens of their right to vote by causing an unprecedented "ballot shortage" crisis.
This is not a mere administrative error. It is a grave disruption of national order, with a state agency directly infringing upon the suffrage rights guaranteed by the Constitution, and an atrocity that has destroyed the foundation of representative democracy.
Therefore, with profound dismay, we condemn the NEC's violation of suffrage rights and strongly urge the immediate dissolution and restructuring of the current NEC.
Firstly, the NEC has committed three grave acts of "betraying the public."
1) Absolute Blockage of Suffrage Rights: By creating an unprecedented situation where citizens are turned away due to a shortage of ballots, a scenario unimaginable in any civilized nation.
2) Orchestrated Disaster: Preparing only half the number of ballots needed for the total electorate was not simply a miscalculation, but a clear act of betrayal intended to restrict the exercise of sovereign rights from the outset.
3) Neglect of Duty and Inaction: Despite a deluge of reports from polling stations starting at 2 PM on election day, no countermeasures were taken for a full two hours until after 4 PM, when the ballot depletion led to widespread waiting...
Secondly, the NEC has exposed three instances of "absolute incompetence and deception," demonstrating the collapse of the election system.
1) Allowing Exit Polls to Be Broadcast: In a situation where voting was delayed due to a ballot shortage, the NEC should have immediately requested the broadcast stations to postpone the exit poll announcements scheduled for 6 PM. Allowing these announcements to proceed is the worst form of incompetence, discarding the fairness of the election.
2) Commencing Vote Counting During Voting: An absurd situation occurred where vote counting began while voters were still waiting in line due to a lack of ballots. Counting votes before the conclusion of the voting process fundamentally destroys the basic order of elections.
3) Suspicions of Downplaying and Concealing the Truth: The number of problematic polling stations, initially reported as 16 at the start of the incident, increased to 50 and then 91 within a few days. This suggests that the figure of 91 problematic polling stations may only represent the tip of the iceberg.
Thirdly, this election has starkly revealed the serious problems with advance voting.
While the original purpose of introducing advance voting was to expand absentee voting and ensure suffrage, its side effects have led to unconstitutional outcomes.
1) Violation of the Principle of Equal Conditions: Advance voting creates a five-day time lag between advance voters and those who vote on the main election day, violating the constitutional principle of equality where all voters should vote under the same conditions.
2) Fatal Flaw in Public Voting: Advance voting is designed to delete the copied identification files corresponding to the voter registry upon the conclusion of the main voting, making it impossible to verify whether a person voted. Conversely, if the identification files are not deleted, it can be revealed who a person voted for by comparing it with the ballot's serial number barcode, thus creating a fatal loophole of public voting.
3) The Problem of Collective Public Voting: The phenomenon of advance voting devolving into collective public voting based on regional sentiment or political inclination has already been observed.
Fourthly, the NEC has flagrantly trampled on the four major principles of elections stipulated by the Constitution.
1) Violation of the Principle of Equal Suffrage: Some voted without waiting, while others waited with numbers indefinitely and ultimately could not exercise their right to vote. This is a violent violation of the constitutional principle of 'equal suffrage'.
2) Destruction of the Principle of Secret Ballot: Allowing voters to cast their ballots amidst a real-time stream of exit poll results and vote counting status after 6 PM is an overt destruction of the principle of 'secret ballot'.
We cannot allow the NEC to continue operating as it is.
The current NEC has lost its capacity for self-correction. It has already suffered moral bankruptcy due to past corruption involving the hiring of relatives of high-ranking officials, and has incurred public outrage due to a lax discipline that saw officials take vacations under the guise of election periods. This incident has unequivocally proven that the future of South Korea's elections and democracy cannot be entrusted to this corrupt and lethargic body.
Infringement of suffrage rights is an act of constitutional destruction that cannot be forgiven by any excuse.
We solemnly demand the following for the preservation of the Constitution and the restoration of democracy:
One: The National Election Commission, which caused the unprecedented infringement of suffrage rights, must be dissolved immediately!
One: The government and the National Assembly must investigate and severely punish those responsible for this incident without exception!
One: A new, transparent, and fair election management body that the public can trust must be established immediately!
