‘Election Influence’ Dispute… Legal Arguments Intensify
Investigation deadline approaching... Special prosecutor's political nature sparks controversy
Special Prosecutor Min Jung-ki indicted President Yoon Suk-yeol on charges of spreading false information under the Public Official Election Act on the 26th. [Photo=Yonhap News]
The special prosecution team led by Min Jung-ki additionally indicted President Yoon Suk-yeol on charges of spreading false information under the Public Official Election Act on the 26th. The indictment stems from remarks made during the 20th presidential election, and this is the second indictment against President Yoon since the special prosecutor's office was launched.
The special prosecution team determined that President Yoon's statement in an interview at the launch ceremony of the Buddhist Leaders Forum on January 17, 2022, denying meeting with Jeon Sung-bae, also known as 'Geonjinbeopsa,' alongside First Lady Kim Keon-hee, constituted false information.
Including Yoon Woo-jin's Testimony... The Key Issue is 'Intent'
The special prosecution team also viewed President Yoon's statement on December 14, 2021, during a discussion hosted by the Kwanhun Club, denying that he had introduced a lawyer to former Yongsan Tax Office Chief Yoon Woo-jin, as a violation of the election law.
In response, the special prosecution team explained, "At that time, the related suspicions were in a situation where they could influence voters' decisions during the election period." This means that the core issue is not simply factual accuracy but the impact on the election and the intent behind the remarks.
However, some legal circles speculate that fierce legal battles are inevitable in court, stating, "There are very strict requirements for criminally punishing past explanatory remarks under election law."
Repeated Indictments, Growing Political Controversy
Previously, the special prosecution team indicted President Yoon on the 24th on charges of violating the Political Funds Act for allegedly receiving free opinion polls from political broker Tae Moo-gyun. Due to the consecutive indictments, the ruling party and conservative factions have criticized the move, questioning if it's an "unreasonable conclusion made just before the investigation deadline."
In particular, there are significant concerns that a political frame is being excessively applied to this case, which revolves around the truth and interpretation of statements, even before a judicial decision. The gap between the 'falsity' claimed by the special prosecution team and President Yoon's side's assertion of 'explanation or an issue of perception' is expected to be clearly revealed during the trial.
Fairness Over Speed of Investigation... Key Points to Watch in the Trial
Regarding this case, legal experts and observers emphasize the principle that accountability before the law must be the same for everyone. They also point out that political neutrality and the principle of strict punishment in the application of election law must not be compromised. As remarks made during an election campaign are being held criminally liable, strict legal review is essential not only for the falsity of the statements but also for their intent and impact on the election.
Moreover, given that this indictment occurred just before the special prosecution's investigation deadline, there are calls for procedural legitimacy and fairness to take precedence over the speed of the investigation. The legal community anticipates that the core issues of the trial will be the extent to which the special prosecution's claims are persuasive in court and whether they can be proven through objective evidence and legal principles beyond political interpretation.
