  • Guaranteeing a Special Counsel Investigation and Realizing Judicial Justice through the Establishment of a ‘Special Tribunal for Election Fraud’³

 [Photo=Yonhap News]Today, the Republic of Korea faces a total crisis in its electoral system, which should serve as the foundation of our constitutional order and the final bastion of democracy. 


The shortage of ballots and the manipulation of computerized systems revealed in a series of recent elections are more than mere administrative errors; they are crimes that undermine the state, systematically violating the suffrage of the sovereign people and damaging the legitimacy of the nation. Despite committing these crimes, the National Election Commission (NEC) refuses to confess the truth and persists with brazen defiance.


As the Jamsil Sovereignty Struggle for the Eradication of the June 3 Election Fraud continues, the "People’s Special Prosecutor for Election Fraud" (hereinafter "People’s Special Prosecutor") has been launched to uncover the truth behind this grave electoral misconduct. At this critical moment for overcoming a national crisis, if the judiciary and the NEC continue to hide behind the shield of "constitutional independence" to conceal the truth and obstruct investigations, public resistance will spread uncontrollably.


To restore the judicial justice lost to election fraud and to rebuild our constitutional order, we strongly demand the following from the People’s Special Prosecutor and the judiciary.


First, the judiciary must proactively cooperate with the Special Prosecutor's investigation led by Lee Tae-han to clear away outdated practices. 


The judiciary has long acted as a shield protecting the NEC’s internal mismanagement and concealment of evidence, obstructing the search for truth by dismissing requests for evidence preservation regarding core assets like servers and log records, or by intentionally delaying trials. 


For the "Lee Tae-han" Special Prosecutor to uncover the substantive truth, full cooperation from the judiciary is essential. The judiciary must promptly issue search and seizure warrants requested by the Special Prosecutor and issue forward-looking decisions that prioritize justice and public interest rather than dismissing evidence preservation requests based on formalistic logic. 


Taking the German Federal Constitutional Court’s ruling against the use of electronic voting machines for the sake of transparency as a model, our judiciary—the embodiment of national intelligence and conscience—must actively exercise its judicial authority to secure decisive evidence to uncover election fraud.


Second, a "Special Tribunal for Election Fraud" must be established to overcome the limitations of the existing judiciary.


Within the current judicial system, it is difficult to fundamentally block the deep-rooted collusive ties between the NEC and the judiciary, as well as the systematic obstruction by the vested interest cartel. The structural contradiction where judges concurrently serve as chairpersons of the NEC has turned the judiciary into an interested party rather than an impartial watchdog. 


Once the Special Prosecutor is launched, the NEC must be treated as a subject of investigation and stripped of all election management and vote-recounting duties. We must reform the contradictory structure where the player also acts as the referee. 


Therefore, to ensure an investigation without sanctuaries and strict judgment under the law, we must break away from existing judicial practices and establish a "Special Tribunal for Election Fraud" with independent authority. 


This Special Tribunal must promptly issue search and seizure warrants requested by the People’s Special Prosecutor, swiftly grant requests for evidence preservation, and fulfill its national mission and divine mandate to uproot the treasonous crime of election fraud that has destroyed our constitutional order through fair adjudication.  


Third, the Special Prosecutor must fulfill its mission by transparently disclosing the investigation results to the public.


The people do not doubt that, even though the judiciary has been deeply wounded by election fraud, it remains the last bastion that can save this country. However, to maintain that trust, the People’s Special Prosecutor and the judiciary must first be truthful before the people. 


Disclose all election-related materials and server data transparently without sanctuaries, and live-stream the entire recount process to the public without a shred of doubt to resolve this mistrust. 


Furthermore, do not block investigations into the evidence presented; guarantee independent investigation and inquiry. We also urge the judge-turned-NEC-chairpersons to sincerely apologize to the people for their neglect of duty and to take responsibility—even for invisible failings—to eradicate election fraud. 


The results of the People’s Special Prosecutor's investigation will inevitably end up on a judge's desk following indictment. Judges must cast off the habits of protecting their own and the inertia of indifference, and instead show a resolute determination to uncover the core of the election fraud and punish those responsible, strictly in accordance with the law and principles. 


We live in an era where not even a needle dropping into a deep lake can be hidden. 


Only when the judiciary removes the protective fence of the election fraud cartel and transforms into the most powerful ally for uncovering the truth will the Republic of Korea be reborn as a normal nation where justice prevails. 


We urge the Special Prosecutor and the judiciary to use their resolute will to operate on and heal the Republic of Korea, which has been sickened by election fraud.
