The ‘ballot paper shortage’ during the June 3 local elections was an act of constitutional destruction that shook the foundations of South Korean democracy and a clear case of fraudulent election.
The suffrage of the people, the most sacred right of the sovereign, was brutally trampled upon due to the incompetent administration and moral hazard of the National Election Commission (NEC), which has lost public trust since the introduction of early voting in 2014. Recent speeches by former U.S. President Trump regarding election fraud have further confirmed that the NEC's electoral fraud is also linked to the Chinese Communist Party.
Regarding the sovereign resistance that took place in front of the Handball Stadium at Seoul Olympic Park following the June 3 incident, a total of 289 individuals are currently being booked and investigated by the police.
Labeling the righteous resistance of sovereigns who stepped forward to protect ballot papers and ballot boxes as mere illegal acts, and abusing public power by requesting and executing arrest warrants against key participants, is a clear anti-constitutional atrocity.
While condemning the atrocities of public power that suppress sovereign resistance while ignoring the essence of the infringement on suffrage triggered by the NEC's fraudulent election, we strongly urge the following:
One, stop the unjust suppression of public power against the righteous sovereign resistance.
Prioritizing the prosecution of protesting citizens with excessive arrest warrants while ignoring the dereliction of duty and the total election fraud by the NEC, the party responsible for the fraud, is a complete failure of fairness in law enforcement.
In light of the Supreme Court ruling related to the May 18 Democratic Uprising on April 17, 1997 (En Banc Ruling 96Do3376), acts of forcibly blocking, obstructing, and suppressing the formation and gathering of the people’s free will, which are guaranteed by the Constitution, are no different from insurrectionary outrages that deny the democratic constitutional order.
The attitude of the prosecution and police to frame the voices of sovereigns, outraged by the infringement of their fundamental rights and suffrage, as "violence" is a clear case of putting the cart before the horse—attempting to punish the people who demand the eradication of election fraud rather than identifying those responsible for it.
We urge the immediate cessation of the unjust suppression of public power and the requesting of arrest warrants against the sovereigns who resisted the state’s infringement of their fundamental rights.
Two, conduct a custodial investigation into those responsible at the NEC for the infringement of suffrage and the destruction of constitutional order.
The anger of citizens who were denied the right to vote and headed to the counting centers, shouting that this is "a country where one cannot even vote," was a resistance caused by the state first depriving sovereigns of their fundamental rights. However, the investigation into the NEC, the primary culprit of the situation, has been consistently delayed and shoddy for over a month.
We urge the prosecution and police to launch an immediate and sanctuary-free compulsory investigation into the NEC's ballot shortage and constitutional destruction, and to conduct a custodial investigation into key NEC officials, including Roh Tae-ak and Wi Chul-hwan, as well as the seven computer department staff members.
Three, we condemn the political circle's opportunistic silence and urge for an opposition-led 'Special Counsel' for the people.
Political circles, regardless of ruling or opposition, deceived the public by calling for a parliamentary inspection and a special counsel immediately after the incident. Once their tactical political interests faded, most opposition lawmakers—with the exception of Representative Jang Dong-hyuk—have remained silent and passive in uncovering the truth. It is because of this political climate that the prosecution and police investigations are being conducted in an inverted manner.
The political sphere must immediately discard its tactical calculations and implement a truth-finding inquiry and the dissolution of the NEC through an opposition-led 'Special Counsel for the People' regarding the infringement of citizens' suffrage.
Those who hinder the investigation of election fraud and insult sovereign resistance are the enemies of democracy.
We urge the joint investigation team of the prosecution and police, which defines the righteous sovereign resistance against the deprivation of suffrage as illegal and carries out indiscriminate suppression, to heed the 1997 Supreme Court ruling, stop infringing on citizens' fundamental rights, and start a full-scale investigation into the NEC, which is attempting to cover up the truth.
We condemn the atrocities of scapegoating the 2030 sovereign protesters—who demand the eradication of election fraud and a re-election—while avoiding the investigation of those responsible for the fraud, and we declare once again that we will fight to the end until the election fraud cartel is eradicated and justice is restored.
